Privacy and Security

At MBC, we are committed to the security and privacy of your personal information.  This policy applies to any transmission or communication of personal information as that term is defined by applicable Ontario and Canadian law (“Personal Information”) and outside of the solicitor-client relationship.  This may include communications with respect to marketing and seminar programs.

Our commitment to protecting privacy is in addition to the strict confidentiality obligations that all lawyers owe to their clients once asolicitor-client relationship is created.  Any communication or transmission of information to MBC or to any member of our firm relating to marketing purposes or to request information about the firm, is not intended to create, and receipt of which will not constitute, a solicitor-client relationship.

 

Why We Collect Your Personal Information

We collect Personal Information for the following purposes:

  • to establish and maintain a responsible commercial relationship with you;
  • to ensure we understand your needs, to develop and recommend suitable products & services and to provide those to you;
  • to manage and develop our business and operations; and
  • to meet legal requirements.

Only those people who require your Personal Information to fulfill these purposes will have access to that information.  We do not sell, rent, or loan any Personal Information to anyone outside of MBC. Any information you give us is treated with care and stored securely and subject to this Privacy Policy will not be used in ways to which you have not consented.

We constantly try to improve your experience with MBC and the types of products and services that we offer.  As a result, there may be times when we seek your permission to collect more information than that specific to fulfilling your transaction with us. We commit to informing you of the rationale behind collecting the information, and seek your consent to do so, whether express or implied.

Although MBC places a very high value on your privacy, at all times we reserve the right to disclose information where required by law; to comply with valid legal processes such as a search warrant, subpoena or court order; to protect our firm's rights and property; or during emergencies when safety is at risk.

 

Your Consent

By using our Web site, or by communicating with MBC outside of a solicitor-client relationship, you agree that we may collect and use information for the purposes for which the information was collected and in accordance with this policy. If you do not agree, please do not submit Personal Information to MBC outside of the solicitor-client relationship nor use our Web site.

We reserve the right to amend this policy from time to time, including to ensure continued compliance with all Canadian and Ontario laws. Please visit this policy regularly to ensure that you are aware of such changes.

 

Our Commitment to Data Security

MBC uses reasonable, industry standard technology to keep secure Personal Information that you submit to us. Unfortunately, no data transmission over the Internet can be guaranteed to be completely secure. Therefore, MBC cannot represent, warrant or guarantee that Personal Information will be protected against loss, misuse or alteration and does not accept any liability for Personal Information submitted to us, nor for your or third parties' use or misuse of Personal Information. Once we receive your Personal Information, however, we make our best effort to ensure its security on our systems.

 

Accessing your Personal Information

We are committed to keeping you informed. If you request it, we will provide you with the Personal Information that we have, what it is being used for, and to whom it has been disclosed. In some limited cases, we may be unable to access or provide some specific information. We will provide reasonable rationale for any inability to release information.

Your ultimate remedy, if you are unhappy with this policy or the service as a whole, is to discontinue the service at any time and request that your Personal Information be removed from our mailing list and/or database.
